1. Agreement to Terms
By accessing or using Paylinq ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
The Service is operated by ARVIGON LIMITED, a company incorporated in Hong Kong with Company Registration Number 79450448, with registered office at Room 803, 8/F, Hong Kong Pacific Centre, 28 Hennessy Road, Wan Chai, Hong Kong ("Company", "we", "us", "our"). Director: DORINA-ANAMARIA GIUMALA.
2. Description of Service
Paylinq is a payment orchestration platform that enables merchants to create payment links, operate a mini shop for digital products, and process payments through multiple payment providers including Stripe, Mollie, Airwallex, and PayPal. We provide hosted checkout pages, digital product delivery, analytics, and related services under the brand name "Paylinq".
3. Account Registration
To use Paylinq you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@paylinq.net of any unauthorised use of your account.
You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this requirement.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use the Service to sell prohibited goods or services, engage in fraud, or violate any applicable laws or regulations. See our Acceptable Use Policy for the full list of restrictions.
5. Payments and Fees
ARVIGON LIMITED charges fees as described on our Pricing page. Transaction fees apply per successful payment processed through the platform. Monthly subscription fees (if applicable) are billed in advance and are non-refundable except where required by applicable law.
Paylinq acts as a facilitator. Your payment providers (Stripe, Mollie, Airwallex, PayPal) have their own terms, fees, and settlement schedules which apply independently. You are responsible for ensuring compliance with your payment providers' terms.
6. Payouts and Settlement
Funds collected via Paylinq are settled to your designated bank account according to your payment provider's settlement schedule. ARVIGON LIMITED does not hold or control merchant funds. Settlement timelines are determined by your connected payment provider.
7. Digital Products and Delivery
For digital products sold via the Paylinq mini shop, you are responsible for ensuring that uploaded files are legal, that you hold the necessary rights to sell them, and that product descriptions are accurate. Paylinq delivers digital products automatically on successful payment via a time-limited, secure download link.
Refunds for digital products are at your discretion as the merchant. ARVIGON LIMITED does not issue refunds on your behalf unless required by applicable consumer protection law.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by ARVIGON LIMITED and are protected by applicable intellectual property laws. You retain all rights to your content (including digital products and branding) uploaded to the Service.
By uploading content to Paylinq, you grant us a limited, non-exclusive licence to host, store, and serve that content for the purpose of providing the Service.
9. Fraud and Security
Paylinq uses automated fraud detection on all transactions. We may decline, flag, or reverse transactions we reasonably believe to be fraudulent. ARVIGON LIMITED is not liable for any losses arising from fraudulent transactions that pass our detection systems.
10. Limitation of Liability
To the maximum extent permitted by applicable law, ARVIGON LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising from your use of the Service.
ARVIGON LIMITED's total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to the Company in the three months preceding the claim.
11. Termination
You may terminate your account at any time via your dashboard. We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with reasonable notice.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page with an updated "Last updated" date and, where appropriate, via email. Your continued use of the Service after changes constitutes acceptance of the new Terms.
